Official Rules

 Terms and Conditions
1. These rules apply to all Ashland Town Center Magical Night of Giving events and/or drawings ("Official Rules"). Entrants agree to abide by these Official Rules and by the decisions of Ashland Town Center, whose decisions are final. Failure to comply with these rules may result in disqualification from any Ashland Town Center events and/or drawings. Ashland Town Center reserves the right to permanently disqualify from any of its events and/or drawings any person Ashland Town Center believes has violated these Official Rules. Ashland Town Center reserves the right to modify or amend these Official Rules, as it deems necessary, with or without notice, at any time and for any reason.

2.  Eligibility Requirements 
Entrant must be 18 years of age and a legal resident of the United States in order to enter any drawing or receive any prizes.  Void where prohibited.  Employees (including immediate family members of employees and/or those living in the same household) of Ashland Town Center, Event Sponsors, and their respective parent companies, affiliates, subsidiaries, advertising and promotional agencies, and each of their respective officers, directors, employees, and agents, are not eligible to participate in any drawing.

3.  How To Enter

NO PURCHASE OR DONATION NECESSARY TO ENTER ANY DRAWINGS AND/OR RECEIVE ANY PRIZES.

To enter any drawing, each entrant shall follow any one of the following procedures:

(i)          Entrant may obtain a ticket from a participating not-for-profit organization, complete the attached Prize Registration Entry form, and deposit the completed entry form where designated at Ashland Town Center during the event.  Suggested donation per ticket is $5.00.  Ticket entitles ticket holder to special store discounts during the event;

OR,

(ii)         Entrant may request a prize drawing entry form from Ashland Town Center, complete the entry form and deposit it with the Ashland Town Center at any time prior to Sunday, November 22, 2009;

OR,

(iii)        Entrant may send a mail-in entry to Ashland Town Center.  To do so, entrant shall legibly print or type on a 3 1/2 “ x 5” card entrant’s first and last name, address, daytime telephone number, date of birth, e-mail address (if available), and the words “Ashland Town Center MDOG Drawing”.  Entrant shall send the card, via U.S. Mail, to Ashland Town Center 500 Winchester Ave, Ashland, KY  41101.  Limited to one (1) entry per household per day as set forth herein.  No mechanically reproduced entries allowed.  Mail-in entries must be postmarked no later than Saturday, November 14, 2009.  Mail-in entries without the required information will not be accepted.  Ashland Town Center is not responsible for any late, lost, stolen, misdirected, mutilated, postage-due, illegible or incomplete entries or for address changes of entrants.

4.  Drawings and Redemption

A.  Promotion Deadlines
The Start Time of all promotions will be 7 pm on Sunday, November 22, 2009.  The End Time of all drawings will be 10 pm.  Mail-In Entrants: Mail-in entries must be postmarked no later than Saturday, November 14, 2009.

B.  Drawings
Drawings for each prize will take place at Ashland Town Center on Sunday, November 22, 2009 between 7:30 pm and 10:00 pm. The drawing will be conducted by Ashland Town Center or its designee, whose decisions are final and binding on all matters relating to the drawing.  Winners will be selected at random from all eligible entrants.

C.  Notification
Winning entrants need not be present at time of drawing to claim prize.  Winners will be notified by certified mail within 14 days of the drawing for prizes at a value of $250 or more.  Return of any prize notification as undeliverable will be forfeited and an alternate winner will be selected.  Winning ticket numbers will also be posted on mall’s website at www.ashlandtowncenter.com

D. Acceptance of Prize
Winning entrants must claim prizes by signing and returning an affidavit of eligibility and release from liability which must be received by Ashland Town Center within fourteen (14) days of the date of the notification, or the prize will be forfeited and an alternate winner will be selected.  Return of any prize notification as undeliverable will be forfeited and an alternate winner will be selected.  To claim a prize, Ashland Town Center may require any entrant to present photo identification.  In the event a vehicle is awarded, Ashland Town Center will require proof of valid U.S. driver’s license and liability insurance before prize is awarded.  All prizes non-refundable, non-transferable and not redeemable for cash.  Each winner is responsible for all federal, state and local taxes applicable to the acceptance and use of his/her prize.

E.  Odds of Winning in Drawings

The odds of winning depend upon the number of entrants received and, therefore, cannot be determined in advance.

5.  Prizes

A.    Grand Prize: $2,000, $500, $300, $200 and $100 from the Ashland Town Center,(2) Las         Vegas Vacations from WLGC, 46” LCD Sharp Flat Screen Television from Ashland Town Center, (2) Prize Packs valued at $500 from Time Warner and 4-hour Limo Ride and Massage from Classy Limo and            Studio 21.

B.    Other Prizes: To be announced.

A complete prize list will be available at the Central Prize Drawing location in the Rackroom Court and Guest Services and throughout the mall on the day of the event.

6.   Winners Consent and Responsibilities
Winner agrees to release Ashland Town Center; Glimcher Realty Trust, Glimcher Properties Limited Partnership, Glimcher Properties Corporation, their respective agents, affiliates, employees, partners, suppliers and advertising, promotional or judging agencies, from any and all liability whatsoever for injuries, damages, or losses to persons and property which may be sustained in connection with the receipt, ownership or use of the prize or while preparing for participation in and/or traveling to any prize-related activity.  Winner may be required to sign an affidavit/disclaimer and tax forms.  Winner will be notified when the appropriate forms need to be signed. Winners consent to the use of their name, photograph and/or likeness for advertising and publicity purposes without notice or compensation, unless prohibited by law.  Prizes are subject to all applicable federal, state and local laws and regulations. Each winner is responsible for all federal, state and local taxes applicable to the acceptance and use of his/her prize.  All other associated fees, costs, surcharges and expenses not specified herein are also the responsibility of the winning entrant, including but not limited to shipping and handling costs. Ashland Town Center may substitute an advertised prize with another prize of equal or greater value, with or without notice, if the advertised prize is unavailable to Ashland Town Center. Winner is solely responsible for all costs and expenses associated with travel to and from nearest port of call for travel prizes. Please refer to the individual travel prizes for conditions and restrictions.

7. Winners List
The names of the winners ("Winners List") will be posted at Ashland Town Center’s Guest Services Center and Ashland Town Center’s Management Office within thirty days of the events and will remain posted there through 60 days. Each entrant also gives consent to release their first name, last initial to be posted on mall’s website.  A Winners List may also be obtained by requesting a Winners List via U.S. Mail to Ashland Town Center within thirty days of the events. All requests must include a self-addressed, stamped envelope and be postmarked no later than January 22, 2010; otherwise, the request will not be accepted. Mail requests to Winners List at Ashland Town Center, 500 Winchester Ave, Ashland, KY  41101.

8. Limitations
VOID IN ANY JURISDICTION IN THE UNITED STATES WHERE PARTICIPATION IS PROHIBITED. Ashland Town Center RESERVES THE RIGHT TO DISQUALIFY AN ENTRANT THAT IT BELIEVES HAS VIOLATED THE LAWS OF THE JURISDICTION IN WHICH THE ENTRANT RESIDES AND/OR THE EVENT WAS HELD.

9.  Additional Conditions and Waivers
Ashland Town Center shall not be responsible for any system failure ("Failure"), including without limitation, acts of God, telephone, network, electronic, computer failures of any kind, or for mail-in entries that are stolen, misdirected, mutilated, incomplete, garbled, delayed by computer transmission, lost, late, damaged, illegible, ineligible, or postage-due. In the event of any Failure, Ashland Town Center reserves the right to cancel any event or drawing, with or without notice, and/or disqualify an entrant from the event or drawing.  Also, in the event of any Failure, Ashland Town Center reserves the right to run the event or drawing among the entries received prior to the occurrence of the Failure, but shall not be required to do so.

ALL PRIZES ARE PROVIDED ON AN "AS IS" BASIS. Ashland Town Center MAKES NO WARRANTIES, EITHER EXPRESSED OR IMPLIED, WITH RESPECT TO THE PRIZES, WEB PAGES AND/OR GAMES, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.  IN NO EVENT SHALL Ashland Town Center, ITS SPONSORS AND/OR SUPPLIERS OF PRIZES BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES ASSOCIATED WITH OR ARISING OUT OF THE EVENT OR DRAWING.

All entries become the property of the Ashland Town Center and will not be acknowledged or returned. By entering the event or drawing, entrants release and hold harmless Ashland Town Center, its respective parent companies, subsidiaries, affiliates, directors, officers, employees and agents from any and all liability or any injuries, loss or damage of any kind arising from or in connection with the event, any drawing or any prize won. Ashland Town Center reserves the right to prosecute to the fullest extent of the law any individual who attempts to forge any ticket or entry form or attempts to in any way defraud Ashland Town Center, its sponsors and/or suppliers.
